8. Orders
All prices are quoted in Australian dollars (AUD), and all orders are subject to stock availability. No rain checks are offered, and all prices and vintages are subject to change without notice. Errors and omissions are excepted. Whilst all reasonable efforts will be made to ensure orders are delivered in full in a timely manner, from time to time circumstances arise which makes this impossible. Fine Wine Merchant retains the right to cancel any order at any time for any reason. If an order is cancelled or is not able to be delivered, a full refund will be offered as quickly as possible, using the same payment method as originally received where possible.
9. Faults and ullages
Occasionally a wine may be faulty – generally affected by TCA (2,4,6-Trichloroanisole, or ‘corked’) or oxidisation. In these rare and unforeseeable instances, Fine Wine Merchant will refund or replace the wines. However, the customer is required to immediately (or as soon as practicable) notify Fine Wine Merchant, and must return the wine with at least 75% of its contents remaining, sealed with the original cork (or original stopper). Where a freight cost is incurred, Fine Wine Merchant will reimburse that amount as well.
10. Governing law
This privacy policy, and terms and conditions, are governed under the law of the State of Victoria, Australia. Any dispute or legal action will take place within the exclusive jurisdiction of the Courts of Victoria.
